One girl one dream Essay Example for Free

One girl one dream Essay This knew that this wasnt the end of the man, he would be back, but next time I will hopefully be a bit more prepared. Eleza is that you? Cried a soft voice Mum? Mum is that you? I didnt think it was possible Eleza I knew you would come back she replied I have to go mum sorry, I cant get close to you because it will rip you apart when I leave again, sorry I shouted while running away down the street No Eleza no! I cant cope without you screeched mum That was the last time I ever saw my mum. Gun shots were fired shortly after I had left, and I just assumed that the police heard her and found out where she was hiding. I knew that the police would be after me soon so I searched refuge on the out skirts of the village, fortunately a couple were also on the run from the police so I went into a home with them, it wasnt an amazing home but at least it provided a roof over my head and food for my empty stomach. Why are you running from the police? I questioned the couple, because of our religion, people here do not support our beliefs and say that we dont belong in this community they stopped, they were going to say more but they could see that I was too tired to listen and so they rested my head in the cloth and rug bed they had made up for me, I thanked them. I started to shiver as it got later into the night so I moved my bed closer to the raging fire to keep warm. I woke up the next morning still feeling incredibly tired because I didnt sleep very well. The couple were very kind to me, for breakfast they gave me a cup of milk and also a piece of bread. Once I had finished eating my food I told the couple what my situation was and what my plans are, they took it as quite a surprise but understood completely and even offered to help out. Knowing that they were old enough to earn a living I stayed along side them for many days. Later on that evening we gathered around the beaming fire and chatted for hours and hours, that was until there was a knock at the door, shh, Eleza hide quickly said the couple silently. I tip toed towards the wooden toy chest and climbed in. open up! demanded a strong deep voice, The woman opened the door to the strange dark clothed man. on the floor, now! he shouted again The did as he said, I couldnt see everything but I could see through a little hole in the side of the chest. Even before the couple could have a chance to speak, the man shot them both in the head. As that bullet pierced into their skull I cringed and couldnt bare the sight, I wanted to cry but any noise could give me the same shot to the head. The strange dark man left, dragging the 2 bodies behind him. I broke out of the toy chest and went to the bathroom; I splashed water onto my face to revive my self, I knew it wasnt worth getting worked up about as I already had a mission to complete. But this incident just made me more determined to get back at the mayor. Whats next? Chapter 11 Screaming with silent rage I crept through the village of murderers. My mind was spinning and I had headaches slicing in and out my skull. I noticed the mayor walking down the street, I followed not too far behind, by the looks of it he was walking towards the forest, I wanted to go see if Oscar was ok but didnt want to chance getting caught. I gave up on following the mayor because he walked into a building and then just disappeared out of sight. I then focused on getting into the forest to see the construction so far. It had been raining the night before so the way up the hill was wet and slippery, I fell many times, but easily managed to get back up again. When I finally reached the top of the hill I saw that the construction hadnt progressed much at all. I went around back to see more, Eleza.. PST.. Eleza over here came a whisper from behind. hey, how are you here, I saw you had a arrow in your back, you cant be alive! I stepped back in shock, that was a tranquiliser, the guard saw me and assumed I was trying to steal the blueprint, so shot me simple mistake, Im sorry I scared you like that. are you still willing to help me then? I wanted to get this over with so I wasnt going to laze about. dont worry about the building Eleza, since youve been gone I have spoken to the mayor and many arguments were fought, but I have managed to convince them to make the building eco friendly. It will cost a lot more money to make but you are the reason why many animals in this forest will be preserved and protected well done! thank-you for doing this for me, how can I repay you for this? I felt incredibly happy that someone was inspired by me. come down to the mayors office with me tonight, I think he wants to talk to you replied the boy. are you mad! I will be killed! I shouted no seriously I can honestly say that you are safe with me, please trust me as I trusted you before pleaded the boy I felt that if I didnt go then it would be mean because he had helped me out a great deal and I should help him in return. ok then, but if anything should go wrong then may your thoughts be guilty for ever I accepted to see what the mayor wanted. I went off into the forest to get ready for tonight, I found Oscar beneath a big branch where we once stayed. He followed me down to the lake, I took a swim to clean off so not to get bad impressions with the mayor. The time passed and by the time I had dried off and got back to the construction site it was already time to go. come on then we best get a move on I said while already walking. We reached the mayors present house on time, we knocked on the door and waited for a response. Helping out- chapter 12 Enter please spoke a well mannered butler Just stay calm and when the mayor wants to talk then let him demanded the boy Hello Eleza, I have heard many stories of you, I understand that you like to stand up for what you believe in, am I right? said the mayor in a strong voice Yes, you are correct I answer in the simplest way possible I want you to do a favour for me, I will pay for your food and sleeping place, you wonder why, but I really do think that you have the courage we need, do you think you can manage to stand up for what you believe in even if the opposition is bigger?. I thought for a while before proclaiming my reply, I would love to take hold of the responsibility of helping out, but do not understand why you would choose me to do this, I was being chased by your men the other day, how can I know that I can trust you? I still wasnt convinced but if what he was saying was true then I would be overwhelmed and hopefully do a good job. Ok, I guess I should tell you now, I havent been completely straight with you, I will look after the forest here for you, but you must leave to southern Africa to do a job for me, flight is paid for, and you will be helping the green team to help decrease the amount of de forestation, and also in your free time you will be helping the smaller children in the schools but if you do not accept this then your precious forest will be burned to the ground for my house to be bigger! So the choice is yours. It wasnt much of a choice so I just did what I had to and agreed to go. I will go but Oscar must be able to fly over with me! Im sorry but it is illegal for wild animals like Oscar to fly over on the plane with you I knew he was right so I just gave in, but made sure that he is promised to be looked after by the mayor. I looked back and went to talk to my friend, Ive never been to Africa, is this a nice place to be? I havent ever been either, but I do know that it is a third world country, with children that need your help replied my friend. The mayor went out the room and talked to another man about the trip, I was shacking but not because I was scared, just because I was filled with many emotions, I was actually quite excited. Journey and arrival chapter 13 I set off early the following morning and endured 12 long tiring hours on the flight to northern Africa, then another 9 hours on a train to my destination. When I got off the train my legs were numb and floppy. When I arrived I was directed into a small long building and was told what I should do. The mayor explained that he is only here today then will be flying home tomorrow, and then he introduced me to my mentor. Eleza, I hope that your stay here will be pleasurable, my name is Mandisa please come meet our youngest residents in our village. I was taken into a classroom where little children stared at the teacher, they gave her all their attention, there was no shouting, it was just calm nice place to learn. I didnt want to disturb them so instead I went into the village centre and saw just how hard it was for them to survive. Could I have a cup of water please? I asked a local The man said nothing, he walked over to a well and scooped out a bucket of water, I went over to him, he handed me the bucket. Is this what you drink everyday? I wondered I looked into the bucket; the water was cloudy with dirt floating on the surface. This wasnt what I was expecting, I was hoping that the people hadnt been drinking this for too long, this water isnt drinkable and could kill if the wrong bits are drank. It is the end of the school day now, come with me to see the children said Mandisa I followed her to the classroom again and met up with the kids, meeting them made me feel important, I felt like I was a vital part of their lives, and that I could make a difference to their lives. Hello, my name is Keon, whats your name? questioned a young boy Eleza, I am here to help you and your class friends out. Yay, no-ones ever come to our village before, other than Aitan, your mayor Is your mum going to pick you up from school? I just wanted to talk to him, I wanted to make friends. My mum is gone Keon fell silent and faced the ground she is gone, but my dad is in the fields. I have to go; my older sister has a disease and needs all the support she can get. Before I could get a chance to comfort him he was gone. I walked down the road and met up with Mandisa. Come; come quick, its Keons sister! She is in desperate need of help. I didnt rely, I just ran with her to his home. There was a huge gathering of people out side of the house; me and Mandisa stepped into the sweltering house mounted of sad people, the mood was unbearable and cries came from the room that Keons sister lay. I ran into the room and looked into the eyes of the girl, I could see that she was in a cycle of eternal pain; I knew this was an incurable disease and couldnt help but feel sorry for the girl, at such a young age, (2 years younger than me and 3 years older than Keon.) I left the house and went to the little mud cottage where I was staying, I sat on the bed and relaxed, I cant stand emotional moments, it just brings back bad memories that Id rather not think about. There was a knock at the door, Hello, Eleza are you in there? sobbed a voice from behind the door, I went over to the door to find Keon looking at me then grasped my waist and burst into tears I hugged him for over 10 minutes before he let go and sat next to me on the bed and told me the tragic news about his sister. His father kindly invited me to the funeral then took Keon back home to get some sleep. I was shattered and was shocked by how much happened to me in one day, and was glad when the day came to a close. But I was eager to see what tomorrow had in store for me. African life chapter 14 Eleza, Eleza time to get up whispered a soft voice in my ear I couldnt talk because my lips were so dry and crisp they remained sealed, I leapt out of bed. They gave me a towel and a bucket of water to wash my face with. The first job of the day was to cover a simple lesson of spelling; I walked to the classroom with the children and was introduced to them all. I then started off the lesson by asking each individual child what they think their abilities are, this helped me to know what their level of learning is currently. The teachers didnt have books to teach from, just a teacher that goes by memory. I didnt get an education so I wasnt doing anything too complicated; I just went over what I already knew. The school day wasnt very long because the children got too hot in the classroom, after the class Mandisa met me outside. She told me that I was here to make a difference to the peoples lives and that I should try to make some tasks up for myself to complete. I thought for just a few moments then decided what I was going to do next. Keon showed me around the village and pointed over to the forest, or what remained of it anyway. I told him that I will protest against the men but I couldnt use force. I think I have a plan, what is the cutest creature in your forest? I questioned The baby monkeys are cute, they live high in the trees Keon replied Lets go then I shouted to him while running through the forest. Keon knew that there was only a slim chance that my plan would work and so he didnt get his hopes up. It took a while to spot any wildlife in the forest because the noise of the chainsaws had frightened them half to death, I crept up quietly to one of the babies, the mother was higher in the trees so she didnt see me coming, Keon gently lifted down the monkey and handed it to me, then we walked for miles and miles to find the campsite of the tree murderers and once there Keon gave a good firm knock on the door and waited for a response. Whos there came a voice behind them I turned around quickly and addressed them, We are begging you please stop cutting down the trees, so many animals die because you have taken away their home and family, here is a monkey that is calling out for your help I had to make up a sad story about the monkey or it wouldnt take effect. I am just against it as you but we must do this otherwise we are out of jobs and wont be able to afford to survive. I could see that the man wasnt the kind to give up easily and so I diverted to the second plan, you know, we will always have a place for you in the village and even though you have had you arguments with them, Im sure if you stop cutting the trees down they will be happy to take you in. if this didnt work then we were screwed. This is something I will consider, it wont be immediate but you idea will not be discarded, dont come back, we will move Im due course. The turned and walked away into their house, we went back to the village and carefully put the baby monkey back exactly where we found it. I went back to my where I slept the night before and rested there. As I lay I thought about all the changes I could make to this village if I put my mind to it, I wasnt an adult, but the village treated me as one and made me feel wanted. This was when I knew, my dream has become a reality, I wanted to make a difference to the world and help those in more need than me. For once in my life I feel that I have done my parents proud and just wish that they could be here beside me. Everyday for over a month I got up and helped around the village, and every evening I would visit Keons mother and comfort her because the loss of her daughter was still on her mind. I had gone through so many adventures in my life and only in 1 year I had gone half way across the world and have witnessed life and death pass me by, and yet am still at a young age of 14, but my birthday is next week and the village kindly offered to have a little bonfire to celebrate, Keon even offered to sing a traditional African song called Kpanlogo this song had a strong meaning behind it but he wanted to sing it because it had a great tune to it. Free life takes a change chapter 15 Keon was now a big part of my life and was like a brother to me, his mum was a thoughtful woman and she welcomed me into her family. I took the job of permanently teaching his class and in the process I even taught myself new things and the children told me about the animals and wildlife that surrounds them. That night Mandisa walked up to me with tears building up in her eyes, she told me that the mayor said that I couldnt stay any longer, he needed help back home. So unfortunately my time in Africa came to an end. I was heartbroken to leave my new family, I felt like someone when I was there and didnt want to go.

Legal Framework - Employement Act Essay Example for Free

Legal Framework Employement Act Essay The company complained that Encik Pokok’s application for leave was only received by Encik Bunga on the 26th November 1996. The leave application was not approved because it was not following the company procedure and secondly, reasonable excuse was not given. Encik Pokok was dismissed without internal inquiry done. Encik Pokok claimed that he had submitted his leave application on the 23rd November 1996. His application was pass to his friend to be given to his supervisor, Encik Daun. He assumed that his leave application was authorized. Encik Pokok said that he went to the Pejabat Kadi on the 23rd November 1996 to settle his sister in law’s case and the next two days, to celebrate their engagement. For the 26th November 1996, he claimed he went to the labour office in Temerloh with his friend. Due to fatigue, he did not go to work. He made a verbal leave application to the company through one of the company’s officers who was available at that time. Encik Pokok claimed that he was unlawfully terminated. He complained that internal inquiry had to be done prior to his termination because it violates Section 14 of the Employment Act 1955 and Item 35 of the joint agreement. Power to make awards 35. —(1) A Court shall have power in relation to a trade dispute of which it has cognizance to make an award (including an interim award) relating to all or any of the industrial matters in dispute. (1A) A Court shall not consider a dispute relating to the dismissal of an employee or make an award relating to the reinstatement of an employee except in circumstances arising out of a contravention of section 82. 2) Notwithstanding subsection (1A), where an employee considers that he has been dismissed without just cause or excuse by his employer, in circumstances other than those arising out of a contravention of section 82, he may, within one month of such dismissal, make, through his trade union, representations in writing to the Minister to be reinstated in his former employment (3) The M inister may, before making decision on any such representations, by writing under his hand request the Commissioner to inquire into the dismissal and report whether in his opinion the dismissal is without just cause or excuse instated in his former employment. (4) The Minister, if he decides to deal with the representations himself, shall before making a decision thereon give an opportunity to the employer to make representations in writing as to the reasons why he considered the dismissal of the employee to be justified. 5) If, after considering the representations of the trade union and of the employer (if any) and any report made by the Commissioner under subsection (3), the Minister is satisfied that the employee has been dismissed without just cause or excuse he may, notwithstanding any rule of law or agreement to the contrary — (a) direct the employer to reinstate the employee in his former employment and to pay the employee an amount that is equivalent to the wages that the employee would have earned had he not been dismissed by the employer; or (b) direct the employer to pay such amount of wages as compensation as may be determined by the Minister. 5A) The employer shall comply with the direction of the Minister under subsec tion (5). (6) The decision of the Minister on any representations made under this section shall be final and conclusive and shall not be challenged in any court or in a Court established under this Act. 7) Any direction by the Minister under subsection (5) shall operate as a bar to any action for damages by the employee in any court in respect of the wrongful dismissal (8) An employer who fails to comply with the direction of the Minister under subsection (5) shall be guilty of an offence and shall be liable on conviction by a District Court to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 12 months or to both. 9) Where an amount to be paid under subsection (5) is not paid in accordance with the direction of the Minister and the employer has been convicted of an offence under subsection (8), the amount, or so much thereof as remains unpaid, shall be recoverable by a District Court as if it were a fine and the amount so recovered shall be paid to the employe e entitled under the direction. Answer: As the defending lawyer, the Company did not make a correct decision in terminating Encik Pokok. The reason is because Encik Pokok has attempted to inform the Company by submitting the leave application form to Encik Daud through his friend on 23rd Nov 1996. Encik Pokok also made a verbal application for leave on the 26th November 1996 through a company official on duty at that time. This would mean that technically he was not absent for more than two consecutive days. Therefore ; According to Employment Act 1955, section 15(2), An employee shall be deemed to have broken his contract of service with the employer if he has been continuously absent from work for more than two consecutive working days without prior leave from his employer, unless he has a reasonable excuse for such absence and has informed or attempted to inform his employer of such excuse prior to or at the earliest opportunity during such absence. The Company also failed to conduct a domestic inquiry to give Encik Pokok a chance to defend himself and offer reasonable excuse why he failed to turn up for work. Therefore Section 14(1) of the Employment Act applies. According to Employment Act 1955 section 14(1), An employer may, on the grounds of misconduct inconsistent with the fulfillment of the express or implied condition of his service, after a due inquiry – (a) Dismiss without notice the employee; Habitual absenteeism (of less than two days at a time but on a frequent basis) would be defined as unauthorized absence from work on a certain number of days per month over a 6 month period. Initially warnings would be given, but if the absence persists, the employee may face dismissal. The failure to be punctual would be treated the same way as habitual absenteeism. In this case, the company failed to show whether Encik Pokok is a habitual absentee by not producing historical records of his attendance. However reported cases show that a breach of contract and termination are dealt as separate issues. As such a breach of contract may not lead to an automatic termination of employment. The consequence of such a breach would depend on the conditions of employment. Conclusion Encik Pokok was a victim of wrongful dismissal and the company must reinstate him immediately. The company has the right to issue written warning for the 24th and 25th November 1996 for unauthorized leave. Question 3 (b) You are defending lawyer for the Company. Has the Company made a correct decision in terminating Mr. Good . Discuss? Case facts: Mr. Good was charged with sleeping while on duty on 12th June 1997 at 7. 30pm in the music room at Tan Sri William Cheng’s house in Petaling Jaya. Mr. Good was instructed Vide a letter on 17th June 1997 to attend an inquiry on 20th June 1997 to hear the charge. Mr. Good says that he had been dismissed without due inquire. He denied that he had committed the offence alleged of and argued that the company had merely acted on suspicion. Answer: Company did not make a correct decision. This is due to the fact that Mr. Good was not caught sleeping red handed and Mr. Bad and Miss Sexy’s allegations were only implied. There were actually no eye witnesses. The court may conclude as it is only allegation as there is no evidence of Mr. Good committing the misconduct, as such the Company even failed to: 1) The Company did not conduct a domestic inquiry. The company should call for domestic inquire as it is an internal inquiry into some alleged misconduct by an employee. The main objectives of the domestic inquiry are to establish whether the alleged misconduct is proven or not and if the misconduct is proven, to recommend a punishment that is appropriate to the offence committed. The complainant is normally the management of the company but sometimes, can also be the victim of the alleged misconduct. At the domestic inquiry, the employer will present its case and the employee is given an equal opportunity to defend himself against the charges of misconduct. Under Employment Act 1955 Section14 (1) where an employer may on the grounds of misconduct inconsistent with the fulfillment of the express of implied conditions of his service, after due inquiry – 2) Absence of show cause letter or letter of disciplinary, As to Mr. Bad and Ms. Sexy’s statement on Mr. Good was caught committing the same offence 3 years ago, there were no records as the company did not issue any show cause letter or letter of disciplinary action. Conclusion The Company did not follow the proper dismissal procedures in accordance to Employment Act 1955, which relates to misconduct.

Strategic Human Resource Management (SHRM) in the Recession

Strategic Human Resource Management (SHRM) in the Recession Abstract In this assignment is presented briefly the world economic recession, the definition of strategic management and is analyzed the role of Strategic Human Resource Management as well as the HRM Policies during the economic crisis. Finally, are proposed some solutions of reducing HRM costs, following the minimizing cost strategy of the companies and presented the potential contribution to the long-term success of a company after the end of the recession. Introduction Every business adopts strategies of acting. The business strategy the that a company adapts and applies is directly linked with its day-by-day changing commercial, economic, technical, ethical and social environment. (Georgopoulos,2006) Until now, businesses were taking in account the factors of a continuously augmenting globalization of the markets and the non-stop pushing from the international competition (Scroggins W., Benson Ph., 2010), the poor ability of the company to protect itself from the increasing menaces from the external environment and technological and administrative opportunities are spread between the society and the business. (Georgopoulos, 2006) World Economic Recession In these factors that bring uncertainty to the company is added the economic recession that burst about two / three years ago. Recession is a phase of business cycle in which there is a significant reduction in economic activity, which is obvious in income, employment, industrial production and sales. As consequence a lot of companies are trying to survive, focused mostly in cost leadership strategy, a strategy that its goal is the minimizing of the costs of production. Strategic Management Strategic Management refers to the most difficult challenge that an organization confronts, on how through the competition for survival and prevalence in the market in the present, will put foundation for a success in the future.(Georgopoulos, 2006) Maximizing Performance is the main goal of all managers, which means the level that the organizations reach their organizational goals with efficiency and effectiveness. This will result the companys success in the long run. (Georgopoulos, 2006) Strategic Human Resource Management and its Role in Present Recession SHRM is a strategic approach of managing one of the most important elements of an organization, its working force. The need of SHRM is more intense in present days, as economies are under recession, businesses have losses and a vast number of people lose their jobs all around the world (Harness T., 2009). The administration of every firm has a cost reduction strategy, searching for potential cost savings and thinking twice of spending its income. The HRM costs are usually significant costs and are usually the first that are reduced in an economic crisis. In situations like this, the HRM has to react quickly, supporting the organization in protecting incoming cash and reducing its operational costs. This is pressing for HRM, as it has to change its focus rapidly, from the pleasant strategies of the economic growth, taken for granted by the employees, to unpopular cost cutting strategies. In this way, HRM contributes to the survival of the business, maximizing its performance if it is possible and to its success after the exit of the recession, having already recruited the most talented employees with the less possible cost, leading the organization to the competitive advantage in the future market (FergusonK., 2009). Unfortunately, for achieving this, HRM adopts unpopular innovations; policies and procedures may be cancelled or postponed; but also this could be helpful for HRM to introduce modern policies of high standard, making the organizations healthier after the recession. Until now, has been observed a trend of the businesses where the majority of companies has fired employees directly after the burst of the crisis and replaced low-performing employees with high performing. Also a big amount of them hire only temporary personnel and augment the size of IT applications. As a result, some of the HRM processes can be strongly affected and some other not to be affected at all. SHRM of Recession and HRM Policies There are policies of HRM that are heavily affected by the recession in the strategy of minimizing the costs, such as planning of workforce, recruitment, training, benefits already given to employees, performance management and appraisal, which have to be minimized immediately. Other practices are less affected, such as job analysis, recruitment, testing, selection, interviewing and development, in which the costs can be more easily reduced . Job Analysis, Planning and Recruitment during the recession In these activities of HRM, the one that has to be almost eliminated is the recruitment. Most of the businesses stop recruitment completely or they reduce it to minimum. This affects the activities of job analysis and planning, as there are no incoming employees. The HR department is really careful of identifying the needs in personnel of the company and designs work positions that cover a larger field of duties and have less specialization. Additionally, they can build a brand name this period, creating job campaigns that will attract talents with the minimum cost. They reschedule simultaneously the planning of the working force of the company and its organizational structure, redirecting the employees in other departments. In this way the costs in money and time from recruitment are almost eliminated instantly (Richbell S., 2010). Testing, Interviewing and Selection during the recession These three activities are not affected so much, as long as there is at least some recruitment, as there are ways to make their costs disappear, mostly through technological tools (Polychroniou P., 2009) that give the opportunity to the companies to test and interview with no cost of transportation, residence of the interviewers, materials etc. On the other hand, always businesses wish to have talented employees, thinking of their performance and success after the end of the recession. In this case, the crisis enables companies of mapping and targetting the really talented employees that maybe they are working for the competitors or are victims of the recession. And all these will cost to the company less than in a growth period (Emerald Group Publishing Limited, 2010). Training and Development during the recession Training will follow the pace of the recruitment as it is costly to train the new employees, as long as they exist. It has huge costs in time and money, so the companies prefer already experienced employees, victims of the recession, to avoid these costs. On the contrary, development is really significant during the recession time. This is the HR practice less affected by recession, as can be done with low cost, using IT solutions, and prepares the business for the exit of the economic crisis, maximizing the performance and contributing in the long-term success. The development can be diminished to the key personnel, identify the top performers and concentrate to the really capable of achieving good performance (Malik F., 2009). Performance management, Benefits and Appraisal during recession A company has after the check of performance of its employees to make a quick classification between good and average employees. This will make also the average or bad employees to be pressed to perform. Also, employees with average performance in a department can be redirected to another one, which will give them additional skills as well. Finally, for maximizing their performance the HR department has to listen to the employees, to keep them motivated and be sincere with them about the difficulties of the period, so that they will trust the administration, they will help it to face the appraising problems by feedback and will augment their willingness for higher performance. Additionally, creating a vision and making them part of it, will increase the level of commitment of the employees (Pate J., 2010). From what the business can save a huge amount of money are the bonuses that can be significantly reduced, without touching the base salaries of its employees, as they are really sensitive in this (Armstrong M., 2011). In the same manner, in the appraisal process, the promotions can be re-evaluated and can be done only the needed ones, trying to minimize the salary augmentation and strengthen their development programs(Armstrong M., 2011). SHRM Solutions for Companies during recession In bad economic periods, companies neglect investing in HRM, as they think of these periods suitable for cutting benefits and firing employees. In the contrary, companies should take advantage of these periods, to prepare themselves for the next period of strong economic growth. Innovation leads to competitive advantage Innovation results out of change, which demands an organizational culture willing to accept it. The contribution of HRM in organizational culture, makes it a really important function of the business nowadays. The innovations that HRM can implement in organizational culture of the company are (Benevene P., 2010): collaborate with ecological ways of communication reducing costs; increase the satisfaction of employees making them feeling important, sharing with them the vision of company; introduce the flexible working transforming it from an employee benefit to a cost controlling strategy (Atkinson C., 2011); increase the employee engagement to the performance of the company; attract and keep talented employees(Pate J., 2010). In this way, HRM, through innovative strategies contribute to the exit of a company from the recession, lowering the costs and maximizing business performance. Being focused on organizational culture, through its processes and the help of technology, HRM can offer real benefit to the company. Conclusion In this period of world economic recession, the HRM has to react in a fast and efficient way, as the longer an introducing solution needs, the less is appropriate. A company with HR department reporting, controlling and innovating all its processes, can be leaded in a huge competitive advantage after the crisis comparing to its competitors, improving or maximize the performance of its employees and as a consequence the performance of the organization and thus, considered to have achieved success in the long run (Kats M., 2010).

Hotel Rwanda Essay -- Film Movies History Historical Essays

I decided to surf the internet in search of inspiration, and I found it on the mediate.com website. Robert Benjamin’s article â€Å"Hotel Rwanda and the Guerrilla Negotiator† definitely caught my eye†¦particularly since I had checked the DVD out from the library last Friday but hadn’t yet watched it. Benjamin’s article piqued my interest enough to do some additional research on Rwanda, and passion was born. While a colony of Belgium, Rwanda was separated into two tribal groups which many say was based on physical characteristics such as the wideness of the nose: the common Tutsi (majority), and the upper-class Hutu (minority). For many years, the Tutsis were powerful and mistreated the Hutus. In 1962, Rwanda gained its independence from Belgium, the power shifted to the Hutus, many of whom wanted to exact their revenge on the enemy Tutsis. In 1993, Canadian General Romeo Dallaire was put in charge of the United Nations Mission to Rwanda to facilitate implementation of the Arusha peace accords after they were signed by the Hutus and the Tutsis. That mission was derailed when the Hutu president’s plane was shot down by Tutsi rebels. The president’s assassination was the precipitating event of what would become known as the genocide in Rwanda. â€Å"When people ask me, good listeners, why do I hate all the Tutsi, I say: read our history. The Tutsi were collaborators for the Belgian colonists, they stole our Hutu land, they whipped us. Now they have come back. We will squash the infestation.† -- ITLM Hutu Power Radio Then, I watched the movie. In a recreation of actual events, we are taken to Kigali, Rwanda’s capitol, shortly before the 100-day genocide began. Ultimately, at least 800,000 – some say over 1,000,000 – were killed. Paul Rusesabagina is the central figure of the story and Benjamin’s designated Guerrilla Negotiator. Rusesabagina managed the exclusive Hotel Des Milles Collines (owned by a Belgian company) and developed a network of powerful allies (including a crooked Hutu army general) – plying them with bribes with the hope they would be available should he ever need a favor. A Hutu married to a Tutsi, and the father of three young children, Rusesabagina initially refused to believe the rumors of increasing hostility and brutality against the Tutsis (routinely called cockroaches by the Hutu rebels). When Rusesabagina can no longe... ...ion has vanished. â€Å"We need the international community to intervene and help us (to do) justice, and then after doing justice, dialogue.† Lobbying the group to invest and volunteer in Africa, Rusesabagina added â€Å"What Africans need as a whole is not only someone who will come and pay their education but it is also to change the systems in Africa. To help us to change, to find lasting solutions. Africa is ruled by dictators. And those dictators should know that one day they also can be brought to justice.† On July 15-17, 2005, the Save Darfur Coalition is promoting a national weekend of prayer and reflection for the people of Darfur to coincide with legislation being introduced in the U.S. House and Senate. Noting that many delayed intervening in Rwanda in 1994 because they weren’t sure the killing was genocide, Rusesabagina has stated â€Å"What is happening in Darfur according to the definition is genocide.† Citing the cry initially associated with the Holocaust and now also with Rwanda of â€Å"never again† as the most abused words, Rusesabagina charges â€Å"When they were saying that in 1994, it was happening again and again and again and again. So, ‘never again’ to me is not enough.†

Europe: The Land Of Self-Discovery Essay -- Personal Narrative Travel

Europe: The Land Of Self-Discovery Every person has, in the course of his or her life, experienced some event that can be identified as life changing. This event can be an emotional enlightenment or a physical change that alters one’s mindset. Such a clarifying incident can happen at any time. However, I believe that such an event might not occur during the first eighteen years of a person’s life. Lucky for me, I have had an experience that I believe changed my outlook on life. The summer before my freshman year in college I went on a seven-week backpacking trip throughout the European continent. I visited ten different countries during the course of my trip, and each country, changed me in a certain way. Some countries made more of an impact than others, but each had enough significance so as to make a noticeable change. In this essay I will outline what I experienced in each country and what that country did to change my outlook on life, and I will explain to the reader why I belie ve that this trip would have a similar impact on each and every one of them. The first country that I visited was Great Britain. My two friends and I stayed in London, which is the largest city in Great Britain. When I first got to Great Britain I did not see much of a difference between it and the United States. Everyone there spoke the same language as me, and it seemed as if the culture was influenced heavily by the United States. However, first impressions can be deceiving because I would come to learn that Great Britain had a great deal to offer. My little group set out to learn everything about London. We visited local landmarks and museums. All in all, I think that London had the aura of a larg... ...eled to Madrid and Seville. Seville has the third largest church in Europe, and this church was built on the remnants of a mosque after the Christians had burned it down. I thought everything in these two cities was amazing. I would say that Spain introduced me to a whole to concept of life; the idea that one should party till four in the morning and just nap the next day. All in all, I think that Europe changed my outlook on life. I used to think that I would want to live in a huge city, but after being in huge cities and comparing them with smaller cities that I know I no know that I want to live in a small town. I would also love to live abroad for a period of time in my life. I think that everyone should go on a trip covering a foreign land. It is a way to realize what is important to you in life, and will always be a memorable experience.

Affermative Action Essay -- Affirmative Action Essays

Affirmative Action   Ã‚  Ã‚  Ã‚  Ã‚  Affirmative Action efforts were started in 1964 to end the long history of overlooking qualified people of color and women from higher education. Affirmative Action sets standards for a business or office of admissions, so that a white man does not have the upper-hand over an equally or greater educated minority. The initial way the government tried to justify Affirmative Action was to develop a human resource approach: first identifying the problem, which is racism then establishing the solution (Phillips 67).   Ã‚  Ã‚  Ã‚  Ã‚     Ã‚  Ã‚  Ã‚  Ã‚     Ã‚  Ã‚  Ã‚  Ã‚  The intent of Affirmative Action helps cut down discrimination in the work place and in schools, despite the fact that some believe that affirmative action is a form of reverse discrimination. In contrast, the first goal of Affirmative Action was to help people who were poor or badly educated, elevating them to positions for which they were not objectively qualified (Buckley 95). Cousens, author of Public Civil Rights Agencies and Fair Employment indicates that the Affirmative Action techniques have the advantage of not only persuading employers not to discriminate when hiring or accepting, but to expand employment and educational opportunities for minority groups (22). Therefore, Affirmative Action is legitimate because it does reduce discrimination in the work place and related areas such as University acceptance of college students. In the end, it should in no way be abolished.   Ã‚  Ã‚  Ã‚  Ã‚  However, Affirmative action is highly controversial. Right now Proposition 209, in California which bans all programs involving race and sex preferences run by the state, has passed but it will not be put into total action due to some questions of constitutionality (Ayres 34). The law will start slowly first, ending Affirmative Action in the schools of California, leading up to the abolishment of Affirmative Action all together. An argument was declared by Mark Rosenbaum of the Southern California Branch of the American Civil Liberties Union, â€Å" Proposition 209 should be declared unconstitutional because it singles out women and minorities and, at a time when discrimination still exists, sought to preclude them from attaining constitutionally guaranteed right, like jobs and schooling.† (Ayres 34). As R... ...Maybe the world hasn’t exactly found equality as a result, but with Affirmative Action, the world is a lot closer to equality than without it. Place Wells Fargo has a wide presence throughout the US territory.Headquartered in San Francisco, the company is decentralized to provide an optimization of the geographical coverage. Therefore, every local Wells Fargo store is like the headquarter for satisfying all their customers. The decentralization is an effective strategy when a company tries to have an effective wide presence on any market. This strategy has made the success of many of the Scandinavian organizations or institutions. Indeed, it allows any company, like Wells Fargo to get closer to its customers and be able to understand and meet better their needs and expectations. As we can see from the case, the company is doing well with its distribution and the customers service in general, it has even been rewarded Retail banker of the year according to US Banker. Consumers want and need a bank office near to the place where they live or where they work. The bank company must be strongly present in the quite big city and in the metropolitan area where the demand for the financial services is important. That is why Wells Fargo has developed a wide distribution, in the US domestic market, throughout more than 6,700 retail stores in 40 states in widely in North America. The acquisition of Wachovia is a part of a new distribution strategy to reach more consumers with an extended presence on the market. Now, Wells Fargo has branches almost all the states from the East to the West both in the North and the South. This acquisition has allowed Wells Fargo to extend its presence in the Eastern part of the US, which represents a huge part of the financial market. Indeed, Wachovia had a strong presence in the part of the US especially in Connecticut, Florida, Virginia, North and South Carolina. 6,700 Banking Stores: 3,296 US Wells Fargo Banking stores * 3,314 US Wachovia Banking stores * 90 Other financial branches Finally, in addition to the classical distribution channel, Wells Fargo use the electronic distribution with its online website where customers can be informed and have an access to some services like checking accounts, make wire transfer, plan a rendezvous with a financial adviser†¦ D. Positioning Without information about promotion, we chose to develop a part about positioning that is, in fact, a sub part of the promotion. In marketing, positioning is the process by which marketers try to create an image or identity in the minds of their target market. Positioning on the global market with a presence in Canada, in the Caribbean, Latin America and other countries, Wells Fargo is especially focused on the US national market. In 2008, after the acquisition Wachovia, a Wells Fargo’s press release said that the company was:† the most Extensive Financial Services company, Coast-to-Coast in community banking†. Wells Fargo is widely recognized in the financial industry. The company has built a very credible reputatio n with its promotional campaigns, its track records and the customer loyalty. The statistics based on the industry and government sources clearly show its size and brand image: * 41st revenue among all US companies ranked by Fortune * 17th most profitable company in the US * 33rd Largest employer in the US * 18th most respected company in the world as ranked by Barron’s * â€Å"AAA† credit-rated by Moody’s * The only standard & Poor’s AAA bank in the US * Among the top 50 companies as ranked by Diversity Retail Banker of the Year according to US Banker * Number-one commercial real estate lender * 18th among the world’s most valuable brands according to the Financial Times Wells Fargo tries to communicate to its customers, how much they are important for the company, saying that they are the center of everything they do. The mission is now to improve the quality of the services. Indeed, the company is, according to the CEO, Mr. Kovacevich, enough de veloped and enough big. The services are now provided with an easy access for the consumers. Now the direction to take is the quality provided: â€Å"We are a big company. We will continue to grow – not to become bigger but as a result of getting better†¦ Regardless of how big we are and how much territory we cover our team shares certain values that hold us together wherever we are and whatever we do†. Wells Fargo puts considerable emphasis on its culture in brand image toward the customers. It wants to be known as a financial partner, for outstanding services and sound financial advice, satisfying all of their financial needs and helping them to succeed financially. The company even considers its customers as friends. However, the company, does not only communicates to its customers but also with: * Its employees, telling them how much they are important for the company. Indeed, Wells Fargo wants to be known as a company that believes in its people as a competitiv e advantage over the competition, a great place to work, and as an employer of choice that really care about them * Its communities, promoting the economic advancement of each partners including those not yet able to be economically self-sufficient.Being seen as a community leader in economic development, in services that promotes economic self-sufficiency, education and social services is a necessity. * Its shareholders, insuring them that investing in Wells Fargo will be a great investment with financial results among the entire Fortune 500 and with the Moody’s credit-rated of â€Å"AAA† (the highest possible one) 2. Customer’s Analysis and Target Market The Wells Fargo’s target market gathers more than 25 million customers across the USA, and internationally.Demographically, the firm does not really have a specific target, and wants to provide financial services to all consumers who need either rich people or those who have financial difficulties. Geog raphically, the customers are divided up over 40 US states out of the 55. Mostly located in the metropolitan area, they are concentrated near the cost (both East and West). However, Wells Fargo, still provide its services in the less dense areas, where people need to have an access to a bank for community banking services.About buyer motivations and expectations, we noticed that customers are looking for efficient, reliable and adapted financial services and advice from the company. They expect good quality services and want from the bank the ability to meet their needs and expectations. Wherever they are, the consumers need to have an easy access to financial services in the bank office and in the Internet as well, where customers check their different bank accounts and transactions. Wells Fargo is specialized in different segments where it is one of the top companies, if it is not the top one.The most important segments are the homeowners, the small businesses, the agricultural bu sinesses, the debit card users and the prime home equity. In these segments, the company is performing very well, providing good quality services and good customer service which allow the company to constantly increase the customer loyalty, being able to keep its customers from the competitors. However, it does not mean that the others are abandoned. Wells Fargo really tries to emphasis that all customers are important, from the consumer banking over lending to the big institutional client. 3. SWOT MatrixThe SWOT Matrix is an important matching tool that us to develop four types of strategies for Wells Fargo: * The SO (Strengths-opportunities) strategies use a Wells Fargo’ internal strengths to take advantage of external opportunities. * The WO (Weaknesses-opportunities) strategies aim at improving internal weaknesses by taking advantages of external opportunities. * The ST (Strengths-threats) strategies use a Wells Fargo’s internal strengths to avoid or reduce the imp act of external threats. * The WT (Weaknesses-threats) strategies are defensive tactics directed at reducing internal weaknesses and avoiding external threatsStrengths 1. Competition w ith Bank of America and Citigroup 8. Superregional and International Banks are growing, they all tend to expand globally 9. Assurance rates increase 4. Industry and Competition analysisThe financial industry counted nine main players before the economic crisis in 2008, which meant height potential competitors for Wells Fargo including Bank of America, Citigroup, US Bancorp, Merrill Lynch, Morgan Stanly, Lehman Brothers, Colonial National and Guaranty Financial Group. The economic recession has eliminated the weak banks that were not doing well enough to overcome the outcomes of the economic crisis, like Lehman Brothers, Colonial Bank and Guaranty Financial Group. Furthermore, an economical selection has been made and only the best banks are still competing on this industry. The industry is currently suffering from the economic recession and all of its outcomes including the deterioration of the housing and credit market, high unemployment rate, and tight credit. That is why many bank s, especially the community banks, are struggling and some even have failed, including Colonial National, and Guaranty Financial Group. Moreover some Banks like Citigroup are not performing well by loosing money and market share. Guaranty had more than $3 billion of securities baked by adjustable-rate mortgages. The bank has seen the delinquency rates on holdings soared by 40% before the federal officials seized the bank in August 2009. As we can see from the chart, in term of revenue Wells Fargo is not the best financial service company. Until 2007; Citigroup was the leader in sales but the economic crisis and the recession that have followed this crisis has led to a sharp decrease of its sales. Since 2008, Bank of America is the leader in sales and the stronger competitor for Wells Fargo. However, its sales are fluctuating whereas the Wells Fargo’s sales show a slow but steady rise. This chart displays the evolution of the net income of the three main companies including Well s Fargo, Citigroup, and Bank of America. Wells Fargo was the last company in 2007 before the economic crisis in term of net income. However, we can see that the two competitors are not doing well enough to keep being competitive, especially Citigroup, which had a decrease of 210. 7%. All of the companies have seen its net income decreased but Wells Fargo has the slightest decrease which allow it the to have the highest net income in 2009 and shows by the way its capacity to overcome though situations. 5.Type of strategies Wells Fargo shows the desire to take part in the top financial companies in the domestic market. This is one element from their long-term strategies. This desire to compete with the market leaders such as Bank of America represent the results expected from pursuing certain strategies. According to this case, we can say that Wells Fargo is pursuing a market development and market penetration strategy, introducing present services into new geographic areas. This stra tegy, has particularly led to the acquisition of Wachovia and the extension of the Wells Fargo’s presence to the Eastern US.This market development strategy has required intensive effort for Wells Fargo in terms of investment and management. This strategy basically involves introducing present products or services into new geographical areas. Here by acquiring Wachovia, Wells Fargo can use a strong presence through the Wachovia’s distribution. The firm’s competitive position was clearly to improve compared to the market leaders. However, the company was rather successful at what it does before the acquisition, which was a primordial condition prior to such acquisition. Then but not least, it already had the needed capital and management quality to manage the expended operations. With this acquisition, the firm has a huge distribution capacity throughout all of the Wachovia’s bank offices and retail stores. Combined with the strategy of decentralization, th is will allow them to reach more consumers and increase the productivity. The year 2009 shows a quick preview about what the firm can achieve in the next years. The acquisitions or mergers are two commonly used ways to pursue strategies like market development or more generally intensive strategies including, market penetration and product development. The market penetration consists in increasing market share for present products or services in present markets through greater marketing efforts (increase number of salespersons, advertising expenditures, promotion, and publicity efforts). Then, the product development strategy seeks increase sales by improving or modifying existent products or services (it entails large research and development expenditures). A merger occurs when two organizations of about equal size unite to form one enterprise. That is what often happened in the Wells Fargo’s history and what helped the firm to grow faster and reach the size the firm had in 2 008.On the other hand, an acquisition occurs when a large organization like Wells Fargo purchases a smaller firm or a firm not doing well, like Wachovia. By acquiring Wachovia, Wells Fargo has realized some major benefits: * Provide improved capacity utilization * To gain access to new customers and products 6. SPACE Matrix The Strategic Position and Action Evaluation (SPACE) Matrix, is a marketing tool used to help the company to define the best strategy to develop according to its internal strategic position (Financial Position and Competitive Position) and the external strategic position (Stability Position and Industry Position). The four quadrants of the Matrix indicate whether aggressive, conservative, defensive, or competitive strategies are most appropriate according the characteristics of the company and its industry. Financial Position * The bank’s return on asset is 0. 44 (decrease of 72%) but superior of all competitors * The Bank’s Net income was 3. 58 Bill ion (increase of 28%) and superior of all competitors * The Bank’s revenue was 42. 84 Billion (increase of 1. 51%) compared to the industry average of 7. 98 Billion * The Bank’s earning per share 0. 912, over the main competitors and over the average industry (0. 91)Total| Rating465520|Industry Position * Deregulation provides geographic and service freedom * Deregulation increases competition in the banking industry * Economic recession * Growth potential * Financial Stability Total| 4213410| Stability Position * Banking deregulation has created instability throughout the industry * Less-developed countries are experiencing high inflation and political instability * The barriers to entry into the market is high * The competitive pressure is highTotal| -4-4-2-4-14| Competitive Position * The bank provides financial services through 6700 offices and retails stores in 40 states * Superregional banks, international banks are becoming increasingly competitive * The bank ha s a large customer base * Customer loyalty Total| -1-5-2-2-10|According to the SPACE Matrix, Wells Fargo presents an aggressive profile. The company is financially pretty strong, has some competitive advantages in a rather stable industry. The Wachovia acquisition is a great operation following the product development or market penetration strategy. 7. External Factor Evaluation Matrix (EFE) Regardless of the number of key opportunities and threats included in EFE Matrix, the highest possible total weighted score for an organization is 4. 0 and the lowest is 1. 0, and the average total weighted score is 2. 5. An organization with 4. 0 total weighted score is responding in an outstanding way to existing opportunities and threats in its industry. It means, the firm’s strategies effectively take advantage of existing opportunities and minimize the potential adverse effects of external threats. Key External Factors| Weight| Rating| Weighted Score| Opportunities: * Many banks are s truggling like Citigroup with negative Operate margin (-57. 9%), Net income ($ -23. 79 Billion), and EPS (-3. 651) * Some Banks have recently failed and have been seized by Federal officials like Lehman Brothers Colonial Bank and Guaranty Financial group: Delinquency rates on their holdings has soared as high as 40% * Grow internationallyKeep improving the internet uses * Develop new products for new businesses * New customers in the Eastern US financial market| 0. 090. 120. 050. 040. 070. 11| 342423| 0. 270. 480. 100. 160. 140. 3| Threats: * Continued deterioration in credit market * High unemployment rate * Tight credit * Many homeowners cannot make mortgage payments * The value of houses has dropped the amount borrowed * The lack of regulation today has blurred the product and services bank offers * Competition with Bank of America and Citigroup * Superregional and International Banks are growing, they all tend to expand globallyIncrease in insurance rates | 0. 100. 030. 070. 050 . 110. 060. 050. 030. 02| 222323423| 0. 200. 060. 140. 150. 220. 180. 200. 060. 06| Total | 1. 00| | 2. 80| Here we can note that the total weighted score is of 2. 80 is above the average of 2. 5, which means Wells Fargo is doing pretty well in the Financial industry, taking advantage of the external opportunities like the bad shape of the competitors and also containing the threats facing the firm like the competition with Bank of America. Of course, the firm could do better, improving its strategies to respond in better way to the threats and get a higher total weighted score close to 4. 0.According to the case, Wells Fargo should expand more its activities on the international market, and develop new financial products and services to be more attractive and competitive. Moreover, the firm must find solutions to overcome the bad state of the economy and its outcomes. 8. C. Internal Factor Evaluation Matrix This strategy-formulation tool summarizes and evaluates the major strengths and weaknesses in the functional areas of business. Like in the EFE Matrix, the total weighted score can range from a low of 1. 0 to a high of 4. 0 with an average score being 2. 5. Total weighted scores well below 2. 5 characterize organizations that are weak internationally whereas scores significantly above 2. 5 indicate a strong internal position. Key External Factors| Weight| Rating| Weighted Score|Strengths: * Brand Image and Culture and values (ethical behavior) * Credibility: Statistics based on the industry and the government sources show its size and strength * Acquisition of Wachovia: extend the distribution channel and the number of customers * Decentralization strategy * Management * Innovation leadership (Internet: E-commerce) * Market leadership in the West: the largest financial institution headquartered in the Western US that has a strong balance sheet and is able to steer through the pitfalls that plagued many of its competitors * Moody’s credit rate  "Aaa† (the highest possible)| 0. 070. 090. 110. 100. 060. 040. 090. 04| 44443343| 0. 280. 360. 440. 360. 180. 120. 360. 2|Weaknesses: * Decrease of the net income and ROA and ROE * Limited international presence * Bad reputation as a bank since the economic recession * Weakness asset quality among high real estate exposure * The Wachovia subprime mortgage problems * Wachovia is overcommitted in credit default swaps| 0. 080. 060. 080. 060. 070. 05| 212212| 0. 160. 060. 160. 120. 070. 10| Total | 1. 00| | 2. 89| The IFE Matrix provides important for strategy formulation. With a total weighted score of 2. 89, we can say Wells Fargo has a pretty strong position in the financial industry and can expect to become stronger and stronger because the firm knows how to create competitive advantages and how to use its strengths. 9.IE Matrix The IE Matrix is based on two key dimensions: the IFE total weighted scores on x-axis and the EFE weighted scores on the y-axis. The Internal External Matrix inputs are the EFE and IFE total weighted scores. As the EFE Matrix and the IFE Matrix have shown, Wells Fargo had 2. 89 for EFE and 2. 80 for IFE. In the IE Matrix, we can see the red dot represents Wells Fargo’s position on the Matrix. It is in the V cell, which suggests that Wells Fargo should use a hold and maintain strategy consisting of the Market Penetration and Product Development strategies; it should the most efficient strategy for the firm after the stage of the acquisition. However, the firm is very close to the cell I, II, and IV, which means the company’s situation can be descried as slow growth and build and where intensive strategies would be the most adaptable like market penetration and market development. 10. Grand strategy Mix The Grand strategy matrix is based on two evaluative dimensions: competition position and market growth. Wells Fargo is located in the Quadrant I of this Matrix, which means that it is in a rather excellent strategic po sition. Therefore, continued concentration on current markets (market penetration and market development) and products (product development) is an appropriate strategy. We can notice that a notable shift from its established competitive advantages would be unwise.
